In a custody case can is their a order i can ask for to initiate the divorce process..?

No; custody and divorce involve separate and different legal issues

(and often different courts) and a petition for custody cannot also be used to initiate a complaint (for divorce).

You (or your attorney) must file a separate Complaint for Divorce in

your local circuit court.
