Legal Question in Family Law in Virginia

Custody of a Child born out of wedlock

My son & his girlfriend have a 5 month old son. They are breaking up and the gf wants to take the child. My son is the main caregiver and supporter. He wants joint custody or residential custody. The gf can't even drive and is bipolar and will not take her medication. He is concerned about the child's wellbeing.
