Legal Question in Family Law in Virginia

Custody of a child

The thing is the mother of my child didn't put my name on the birth certificate and is denying me my child and won't let me see him. How do I go about and try to get custody of him or joint custody of him?

Re: Custody of a child

You file suit for such custody in the

Juvenile & Domestic Relations District Court (J&DRDC). Go to the clerk's office(civil division), tell them what you want to do, and they will give you the necessary paper work which must be completed to initiate the filing.

Paternity may be an issue at the scheduled hearing and, therefore, if the child's mother contests your alleged fatherhood of her child at the hearing, you will also need to ask for a paternity test to establish(or not) the paternity of the child for which you will be expected to pay.
