Legal Question in Family Law in Virginia

Custody

I have a child with a women that lives with me. Thing are not working out with the mother and me. The mother is going to need to move out soon. The mother also has a seven year old son that stay with us five day/nighs a week. The mother pretty much has nothing besides a car, she does not make a lot of money either. I know she would have a hard time affording a apartment and providing a good home for the kids. My question is what are the changes that I can get Legal custody of only my child, not the seven year old boy ? I have seen some of my friend go through the Faifax county courts and most of the time if not all the time the mother is getting custody. The mother is from a 3rd world country and only has been in the USA for about 10 years. Will the courts look at that ?

Of course you have a chance to get custody! The standard generally is what is in the child's best interests. If you make a good living and can provide a good home for the child I'd say your chances are good. There is no presumption in favor of either parent.
