Custody

I have custody of my child who is 12. More than a year ago I was arrested for shoplifting. The case was subsequently dismissed so I was not convicted at all.

Can this be used against me by the non custodial parent to gain custody of my child?

Otherwise, the child is in a perfectly happy home and does not want to leave. I am remarried. I am not receiving child support.

The non custodial parent could try to use this arrest against you in an attempt to win custody of the child but he'll need much more than that in order to prove your unfitness as a parent who should be deprived of her custodial status.
