custody

my daughter is 12 years of age she wants to live with me her and her stepdad doesnt get a lone mother says no she cant live with me and my wife.I have file for custodymother has put bruises on child 3 times social servies has been called all 3 times they have not done anything they say the mother just got carried a way. Do i need a lawyer to go to court with me.
