Legal Question in Family Law in Virginia

custody

i have been hospitalized several times for depression and they have labeled in the past as bi-polar. i have recently gotten out of the hospital am asking for a divorce on cruelty and constructive desertion. my kids are still with him because he would not let me come back home. we have joint legal custody and he has primary physical custody pending a court hearing. i am currently going to a psychiatrist who has taken me off of my meds except for one to sleep and does not think i am bi-polar. i am doing fine off of the meds and since i have been out of the abusive environment. he has a substantiated case of emotional abuse against me and the kids through the navy. do i have anything to worry about being that she took me off my meds and i have been fine? will the past diagnosis affest the court decision if she thinks it was wrong and has taken me off the meds? i am worried that the court will not like that. but like i said i am stable and doing fine without them, working 2 jobs etc. (we are going to court for temporary custody)

Re: custody

The court will necessarily have to consider your past medical history and how that history may affect the best interests of your child(ren).

Hopefully, you have retained the services of an attorney to represent you at this pending hearing.
