Legal Question in Family Law in Virginia

Custody

My husband and I have been separated two years, he won't sign the paperwork. I have started to date. My kids have met my boyfriend on a couple social occasions. Never has he stayed the night with them here nor have we shown any public display of affection. My husband and I have a 60/40 split on time with the kids (I have them 60%) He has filed for full custoday due to me dating. There has been no inappropriate behavior on my part like he claims. During our marriage he was extremely abusive(mentally and verbally) his living conditions for the children aren't good (youngest doesn't have own room or bed. middle child's room infested with flies due to unkept animals) he takes the kids to his construction jobsites while he works. Does he have a good chance of winning custody.

Re: Custody

Yes, he might win shared custody(not because of your dating), but very unlikely that he would be awarded full custody.
