custody and marital residence

my ex and I have been apart for 3 years now. I am still in the marital residence because he won't let me out. We are also going thru a custody battle. If I let him buy me out of the house does that give him a leg up on the custody battle?

No, it does not, assuming that you would have other suitable living quarters available for the subject of the custody suit in the event of such a buyout.
