Legal Question in Family Law in Virginia

Custody in Virginia

I am seeking custody from my ex for our 4 year old son. He received custody due to my past incarceration. I have filed ''motion to amend'' and have a court date on 4/27/07. My child is now in my custody for visitation and I want him to remain with me until the court date. How can I file the paperwork for it?

Re: Custody in Virginia

No, that's the wrong way to go about it, i.e, to improperly withhold custody of the child from the parent who now has legal custody. Your child should now be returned to the custodial parent in compliance with the terms of your current visitation order. To do otherwise will merely prejudice your chances of succeeding in the matter now scheduled for a hearing on 04/27/07.
