Legal Question in Family Law in Virginia

custody of 14 yr old

I left my husband 4 months ago due to verbal abuse. We don't have a legal seperation only a verbal one. I have our 11 yr old child that lives with me at my parents home while my husband resides at our home with our 14 yr old. I give him most of my check every week to help with bills and see my 14 yr old when possible. He now wants to move to another state with out 14 yr old to spite me and I do not want to lose my son. Is there any way I can stop him? Do I have any say so even though he's 14.

Re: custody of 14 yr old

Yes, you can file for full custody of the boy.

That doesn't mean that you'll necessarily get it(meaning full legal as well as physical custody), but it does mean that a Virginia court will have jurisdiction to decide who the boy lives with and where.
