Legal Question in Family Law in Virginia

custody of my 17 yr old niece

My 17 yr old niece lost her father almost 2 yrs ago and she has asked me to take custody of her because her mother and boyfriend are moving to maine and she doesnt want to go and leave her family and friends and as far as myself there have been many concerns with her well being while she is with her mother. Can she make that decision and how likely is it that the judge will take into consideration of what she wants and where do I need to start ? I live in the state of virginia.

File your petition for custody of the minor in the city or county of the Juvenile & Domestic Relations District

Court where she currently resides.

The clerk will have the necessary forms

for you to fill out in order to complete the filing.

A hearing will be scheduled and the court will decide the matter based upon what it perceives to be in the best interests of the subject child.
