Legal Question in Family Law in Virginia

If when my daughter was born her biological father refused to be on her birth certificate and sign the paperwork. Do I have to add him to it now over 4 1/2 years later that he has asked me how do I feel about her having his last name as well as him being on the birth certificate (which he had no idea he wasnt on until I told him during a convo we were having) He thought that after he did the paternity test that he was automatically added on the certificate.

No, you yourself are not required to do anything in terms

of adding this father's name to your child's birth certificate under the circumstances described and unless a court of proper jurisdiction in the matter ordered the agency in Richmond responsible for maintaining vital statistics to change the birth certificate, it will remain as it is
