My daughter was born into a marriage with a militay step-father. He put his name down as her father. She is now 10 years old and wants her biological name, which is mine. This has all been proven. The marriage disolved in 2004 and I have provided for her and she has lived in my home since that time. I am the non-custodial parent and her mother the custodial. Her mother has been against me changing her name to mine only because of the Tricare health insurance. The step father doesn't want to drop her Tricare. He lives in another state and hasn't seen my daughter in years. If I go to court and change her name to mine, I can provide her with state health insurance. What is your legal opinion of this insurance mess? My hands are tied on the military health insurance. My daughter deserves the right to her real name. At wits end.

So, file for the name change in the circuit court of the locality
where your daughter resides and serve the mother with
a copy of the petition.
