Legal Question in Family Law in Virginia

My daughter and her husband handed their kids over to me when CPS was called because they where sleeping under a tarp. They left their rental home and all their possesions. They abandoned thier vehicle and ditched thier id's. I have been caring for them since 9-1-17 I can no longer take care of them and have another relative that is willing to take all 3 boys in. I was told they could file an emergency protective order and a UCCJEA becuase they parents and kids lived in Maryland. I am in Virgina and so is the relative willing to take them in. They were met with resistance at the courts and said that they didn't think so. What do we do and is the clerk wrong? All I have is a letter from the parents giving me permission to make all medical decisions while in my care and a letter from CPS to call the local police if the parents show up. We can not get in touch with the parents.

I suggest you consult with a VA attormey experienced with domestic relations matters in

the Commonwealth to determine the best way for you and your relative to

proceed with this matter to secure a valid order from the local court concerning the custody of these children.

It would seem that they would be better off with a relative rather than in foster care.
