daughter wants to live with me

Last year my ex took me to court, and the court granted him legal custodian (joint custody...I used to be the legal custodian). Ever since then, I've been trying to get her back through appealing, but that's difficult (I'm in court of appeals now). My daughter tells me time and time again that she doesn't want to live with her dad (she wants to live with me), but she's afraid to say anything to him b/c it will hurt his feelings. She's 9. Any suggestions on what to do?

Wait until the child is 12 or 13 and is willing to express her preferences openly to her father as well as to a court.

Then, try again(if it is really necessary).
