Legal Question in Family Law in Virginia

My daughter had a scheduled meeting with her attorney and the attorney did not show up. The attorney has not answered any of her phone calls or emails since. My daughter has a court appointment (custody hearing) next week. What should she do if this attorney fails to contact her or show up for the hearing?

Also what recourse does she have with regard to getting her retainer back?

Thanks You

Michael Hendrickson Law Office Michael E. Hendrickson

Her recourse would be to explain to the judge at the hearing what has happened and then request that the matter be continued for a sufficent period to allow her to obtain new counsel.

And, yes, if in fact ther lawyer has done nothing for her, she should make written demand for the return of the advance fee and file a bar complaint if such doesn't happen.
