Legal Question in Family Law in Virginia

I dealt with a man for 2 1/2 yrs just had a child by him 4months ago, however; this man is married and now we are going through court regarding custody and visitation. He wants weekend stays (Fri-Sun) and I'm not agreeing with that idea with my son being so young. Mentioned when he's older that's all fine and dandy. What's the likely hood that the judge will grant him weekend stays with him being young? (Mind you me and the wife do not get along of course)

Hard to say as the judge must consider many factors in deciding whether this kind of visitation would be in the best interests of the child. Howver, if you are

opposed to it, you need to offer credible and persuasive reasons to the

court as to why it should not be allowed and what kind of visitation should be

permitted in its place (if any).

There are different factors for court to review in these cases. The judge can choose how much weight to give each factor. Judges normally want both parents involved unless there is something extremely negative regarding non-custodial parent. Web: www.sherylshanelaw.com. Attorney Shane.
