Desertion

My husband packed some clothes a few days ago and left me and our children for another woman. I have asked him to come back to work this out and he has refused. He is now threatening to come take the truck that I am driving and anything or everything that he wants from the home. The truck and home are in both of our names. He still has a closet and dresser full of clothes and keys to both the truck and the home. Can he do this legally? Can I have the locks on the house changed? How can I prevent this from happening?

You would be well advised to arrange a consultation with an attorney knowledgeable in Virginia family law matters who can advise you as to how best to proceed in this situation, and how to acquire from the court the protection of temporary orders for support and the right to remain in your home with your children,

pending whatever final resolution of this matter which may be required(including the possibility of divorce).

As of now, and, in the absence of a court order stating otherwise, your husband has as much right to be in your home as you do and, therefore, you would have no legal basis to exclude him until a court rules that he must vacate the premises and look elsewhere for his shelter.
