Legal Question in Family Law in Virginia

Desertion

I have been seperated from my spouse since 99. He has been kicked out of the Military, I want to divorce but do not know where he is and have not known since July. Is this grounds of desertion?

Re: Desertion

You do not need a ground (such as desertion) to obtain a divorce. You have been separated long enough under VA law to obtain a no-fault divorce. You can obtain this divorce even if you do not know where he lives. We have procedures that we must follow if we do not know where he is but they are fairly simply and do not require too much time.

Long story short....you can obtain a divorce even if you do not know where he is. You can either hire an attorney or contact the local county courthouse and see if they will assist you. If not, I am happy to help you. Just give me a call at 703-968-3974.
