Legal Question in Family Law in Virginia
Discovery
My ex is incarcerated. His parents are asking for the same visitation schedule that HE had. Their attn. has requested discovery. I have medical and school records that I would like to use as evidence, but I don't feel they have the right to view. In the code, it mentions something about discovery not being ''privileged'' doc's. Would these records be ''privileged'' since the grandparents do not have parental rights to such information and his father has not requested the information (although he has the same rights to copies as I do, if he'd just contact the doctor/school).

Re: Discovery
You can simply refuse these discovery request(s) involving these documents or records on the grounds that they contain privileged information that the petitioners(grandparents) are not entitled to access.
