Legal Question in Family Law in Virginia

Disertion

My husband has bipolar disorder and is in denial and refusing all treatment. It has made it necessary for me and my 17 and 15 year old children to move out of the house. My husband says that because he is diabetic, if anything should happen to him I could be charged with disertion. Is that so and what legal implications could that have if any?
