divorce and children

i am married i lived in mich. in 2006 my husband left the state went to alabama for work and because he needed space. i decided that was not fair and told him that we should divorce he became a resident of alabama and in 2007 july i moved to va where i now reside did i break any laws by taking my kids without permission i have sent him divorce papers he will not sign them because he doesnt agree to the terms what do i do next i dont have a lawyer now she is very expensive he does not pay child support and i let him visit when he wants he talks to his kids everyday i need to start gettin child support but i dont know where to go or what the next step is i was told to go to juvinelle domestic court.can u please advise on what my next step might be. he has since moved back to mich.

You can find the location of your nearest district child support enforcement office by going online to the Virginia state government website and clicking on the link to child support.

You can then arrange to make an application for services with the Division of Child Support Enforcement(DCSE) who will arrange for an interstate petition for child support to be forwarded in your behalf to their sister agency in Alabama which will then be contacting your husband to arrange for the entry of an order for child support.

Alabama should collect the support at least once a month from your husband which will then be forwarded to DCSE's main office in Richmond which should then distribute these funds to you. (These agencies can also attach any tax refunds which may be due your husband and take other enforcement actions as well if he falls behind in his support payments.)

Once you have the all important interstate order for child support in place and begin collecting support, you may then want to consider contacting one of the low (or no) cost legal services providers in your area as to how you should proceed with your divorce matter.
