Legal Question in Family Law in Virginia

divorce and debt responsibility

OK,25 years of marriage & I have seen alot but recently my red flag has gone up. We refinanced our house a year ago and added 100,000 to the mortgage, (he bought a new corvette, i got a malibu and we upgraded the house) a couple of months after he bought the vette he sold it & put the money in an acct that i have no access to, also he has taken out credit cards in the amount of 95,000 & is gambling all this money away. So far he has lost $45,000 and is still going to Vegas. My concern is being help responsible for the debt on these cards, he says the cards were in his name only but we are married so that holds me responsible right? i find it interesting that i have no right to spend money on any of these cards but if for some reason they were not paid i would be held responsible. i am getting ready to file for divorce but am also concerned that he will hit me up for alimony since i make more money then him, all of a sudden i am realizing that i am in a very bad situation. so my questions are can i divorce him and not be held responsible for this debt that i had nothing to do with and how often do husbands have the right to go after alimony when there is a divorce.

Re: divorce and debt responsibility

In any divorce action, the debt you've described would likely be apportioned out to your husband and there would be little chance of a court ordering you to pay him alimony. (Merely because there's a pay differential between you and him would not be a basis for the court to order such support.)
