Legal Question in Family Law in Virginia

divorce - dividing assests & misc

I have a few questions concerning divorce. it is not planned yet, just trying to prepare myself, incase.

If I was to file for divorce, I would move to Florida to live with family temporarily until I am settled with job, home, etc... I would want to leave my son with his father temporarily until I make all the arrangements. (home, job, etc...) since for 15 years I have been working for our company. Is this considered abandonment or desertion?

We also own a corporation in which I own 51% - what is the process to receive share of that along with stocks and bonds and misc. collections.

My husband handles all the finances. I receive a pay check but it is given to him to pay bills. He holds the checkbooks and I only have one credit card in which he holds and pays on with my check.

Please give me some advice.

What do I need to do first?

Re: divorce - dividing assests & misc

As to your first inquiry, it is unlikely that your departing the marital home under the circumstances described would likely be construed as "abandonment" under applicable Virginia law.

As to your second question, you should have a (Virginia not Florida)attorney representing you in making sure that you get all of your share of marital assets that you may be entitled to, including that of the family business which you've mentioned.
