Legal Question in Family Law in Virginia

Divorce that Never Seem to End

I have been in a situation for almost 2 years whereas my estranged husband keeps dragging out the final divorce. He refuses to accept any valid property settlement. I make more money than he does but I was left with all of the debt and even though we shared custody, I pay for all childcare for our children. He has accused me of adultery which simply is false. I deny one group of dates and allegations of adultery and then he just files amendments and picks other random dates. I feel this may never end. I just want to concentrate on raising our children and move on with our lives. How long can a divorce in Virginia go on for? My attorney seems to act like it is 2 years.. but because of a new court procedure for scheduling these dates.. I could be separated for 30 months and still not have a final divorce. Is this true?

Re: Divorce that Never Seem to End

If your talking about jurisdictions with heavy divorce dockets such as Fairfax Co., Richmond, or Norfolk, it could very well be true. Local courts are generally free to impose their own rules when it comes to scheduling cases.
