Is the divorce free is the spouse is incarcerated and the charge is Convicted Sexual Offender and there are children, in the home, that the spouse is NOT to be in contact with. The spouse did not report their address before the due date and was incarcerated this time, for 2 years.

No, a divorce is not "free" (in neither a literal nor figurative sense) to either spouse under the circumstances described.
