My husband & I have signed seperation papers.We have agreed and signed papers stating that I give him money for his share of the house..my lawyer said that since the papers are signed and I am refinancing the house to put it in my name and having the deed changed also..it would be safe to give him the money before the divorce is final...please I need a second opinion..Thank you...PS.We have no children

Your lawyer's advice is sound since the PSA (Property Settlement Agreement)is a binding contract once it has been signed by the parties, and, consequently, once the house is refinanced only in your name, and your husband's name is removed from the deed, he can have no further claim to the house----EVER, (unless, of course, you permit it by readding his name to the deed).
