Legal Question in Family Law in Virginia

Divorce while living in separate states

My husband and I have been separated over a year. He lives in another state and has not been in contact with me or our son since last April. He has not paid any child support and I do not know how to contact him. I already have full custody and a child support agreement. How can I file for divorce without having an address for him? We own a house and car together and I have a 401K. Our son just turned 5 and is in full time daycare, so money is very tight. I can't afford to hire someone to track my husband down for me and am not sure what steps I need to take. Thank you.

Re: Divorce while living in separate states

You should visit the clerk's office of the civil division of the circuit court in your area and arrange to pickup a divorce packet explaining how to proceed "pro se" (representing yourself without an attorney). This packet of materials will, also, explain what you have to do in the event that you are unable to find your spouse

in order to serve him with legal notice of the proceedings.
