divorce...

I was married in spain. we never lived together or shared anything. i moved back to the states (military) and now have filed for a divorce. she is playing games and has accepted the papers but will not sign them and mail them back. she was not ''served'' via afadavid, just mailed the papers to by our lawyer. will i still be granted the divorce here in the states. it has been 7 monthes since i filed.

Your best bet is likely for you or your lawyer to call one of the law clerks of the circuit court judges who will be assigned to your case and ask her/him as to their opinion on the legal effectiveness of the service of the papers and whether or not it would now be advisable to seek the court's permission to effect constructive service upon the defendant, i.e, by way of four weeks of consecutive publication of a legal notice of the divorce in a local newspaper.
