Legal Question in Family Law in Virginia

Divorce options

I live in Georga and my wife and I were married in Virginia. We havn't had any contact with each other since August of 2004. Is there a way that I can find out if shes filed for a divorce and if she hasn't what options do I have on obtaining a divorce. Do I have to do it in the state I live in or can I file or divorce in Virginia?

Re: Divorce options

You may file for a divorce in any jurisdiction in which you have been a resident for a minimum of six months.

You can make inquiries with the Departments of Vital Records in any state to ask that a search be perfomed for any divorces entered in your name.

Good luck.

Re: Divorce options

You can file a case here in Georgia. Whether that is a good or bad idea depends of information not in your post. If you're in the Atlanta area, contact my office to discuss it.

Assuming that a divorce wasn't done by publication, you'd know about it by being served with it.
