Legal Question in Family Law in Virginia
Divorce papers
My husband was served but he did not sign anything, not even the waiver. He does not want the divorce. Now the divorce is just pending. He is out of the country now, and will be back at the end of August. Should I hire a lawyer to make this move faster? Or is there something I can do myself? He will not sign anything. I thought this would be an uncontested divorce, but doesn't seem that way anymore. I don't have a lot of money for a lawyer. Please help!

Re: Divorce papers
If there are no major property or other issues in the marriage to be resolved, and your husband refuses to cooperate in signing the papers for the uncontested divorce, then proceed with the matter as if it were contested and, if necessary, reserve the complaint and summons upon him which he will have 21 days to answer.
However, if there are major issues in the marriage which need to be resolved such as support and maintenance, child support, custody, visitation and marital property subject to equitable distribution, then you will very likely need the services of an attorney to take over the matter and represent you.
