Legal Question in Family Law in Virginia
divorce and property
I am divorced. My husband has posession of a car that is in my name and I am a co signer on the morgage. He is attempting to sale the house and is not making payment on the car that is in my name. The late morgage payments are also going against my credit. how can I be relesed of these debts( get them out of my name) and do I have any right to the sale of the house if I am on the morgage?

Re: divorce and property
All of these kinds of issues should've been disposed of in a property settlement agreement which was then incorporated into your final decree of divorce. Unfortunately, it sounds as if such may not have happened in your case, and therefore I would advise that you arrange for a consultation with a Virginia attorney who is appropriately knowledgeable and experienced in the Commonwealth's domestic relations laws and practice
and who can advise you as to what can now be done later which should've been done much sooner with respect to the various issues which you've referenced.
