Legal Question in Family Law in Virginia
Divorce and Property
I have been separated for six months; estranged husband will not sign a PSA because he does not think he should have to pay his half of a vehicle purchased during the marriage, but is in his name. I am three weeks away from closing on my own home (he owns a home that he had before the marriage). I know that if I buy without a settlement agreement that he ''could'' be entitled to ''half'' (could meaning the court here takes into account when and why the property was acquired, and also the lenght of the marriage (3 months) among other things.) My question is: can he sue me in the divorce for half the equity of my new property or half of the value of my new property?

Re: Divorce and Property
Sure, he could sue, but no court would award him anything on his claim under the circumstances which you've described.
