How to divorce without ones signature.

I need help, my husband and i were married almost two years ago. The day we got married about three days later he left and never came home. He is in another state and gets in trouble with the law a lot. He was just recently up for a hearing which he got off of. He refuses to sign the papers unless i pay him so much money. I have no job meanin i have no money. All this was done i california but i moved out to virginia i havent lived out here long. He wont sign the papers at all and i dont know what to do or how to proceed with my divorce. I sent him the divorce papers back in july of 2005 that was the second time i sent them to him. He still tells me no i wont sign them. I need help i dont know what to do.

You may file divorce in any jurisdiction you have lived in for at least six months.

Filing for divorce is not that hard. Having him served in another state may be more difficult. Agreeing to terms of money or whatever issues exist would have to take place in a courtroom if you two couldn't agree.

I have no idea what papers you need him to sign. Divorces are filed in courthouses and then served on people. If you are trying to get him to sign a separation or a property settlement agreement and he won't then just move on and get your divorce filed and get rid of him. Hire a lawyer. This case isn't that difficult you shouldn't have to pay that much.

You're likely going to have to return to the proverbial square one in Virginia and begin your case all over again from Virginia, after you have lived here long enough to begin divorce proceedings.(Probably one year).

You do not and will not need your husband's agreement or signature on the papers in order to consummate(the divorce) matter.
