My sister's husband wants her to leave, she has confessed to seeing another man one time. They have two children, If she left wouldnt that be considered abandonment. He wants the kids to stay?

Yes, it could be, depending upon all of the relevant facts. Your sister's moves in this situation should not be dictated by her obviously disgruntled husband. Rather, she should make these decisions herself only after she's had sufficient time to consult with an attorney as well as members of her own family in order to determine what course of action may be in her best interests as well as that of her children. Which, given the situation as it apparenty now is, are not likely to coincide with her husband's ideas in regard to these issues.
