Legal Question in Family Law in Virginia

Divorce in the State of Virginia

I have been apart from my estranged husband for since 2002. I do not have a substantial amount of funds to pay for a divorce by myself, that I am aware of, yet my husband has not made any efforts to this either. As a matter of fact, I couldn't even begin to tell you where he is? He is no longer at the address we once shared and the only phone number I have is just a voice mailbox where my messages never get returned. My question is, since we have been apart for this much time, is there something that can be done to get this divorce started and finished due to the amount of time that's gone by? PS-There are no children involved-just a house and a car.

You can get the divorce finalized by serving him through the local newspapers, a process called service by publication. That will not change anything regarding the car or the house (except it will change form of ownership of the house from survivorship mode to not passing at death to the survivor.

The process can be done without an attorney, but it's a little bit tricky.

You may wish to check with one of the local low cost legal services providers in your area of the Commonwealth to determine whether you might qualify for one of their attorneys to assist you with your divorce matter at little or no cost to yourself.
