Legal Question in Family Law in Virginia
My divorce will be final in a month. I'm 16 weeks pregnant with my boyfriends child and we plan to get married as soon as the divorce is final. We do not want my ex husband's name on the birth certificate. He has been in Iraq for the last year. It is obviously not my ex's baby and my boyfriend is support me and the baby fully.
My question is if my boyfriend and I get married right after the divorce will his name automatically go on the birth certificate? We saw that national law states if I haven't been divorced for 300 days my ex's name will be on it, but we want to avoid this!

I don't know where you saw your information, but it is wrong. The name on the birth certificate will be the father, if both the mother and father agree who fathered the child.
