Legal Question in Family Law in Virginia
I an getting divorced and it is not contested. My wife and I are using the seperation agreement as the basis for the divorce decree. On May 4th 2010 our divorce went before the judge in Northampon county Virginia. I had not heard friom the courtas of May 17th 2010 so I called them. I was told they were waiting for the divorce decree. I did not go to court since I had read the divorce decree that was drafted fron the seperation agreement, and this was what was to given to the judge . When I asked why the coutr did not have the divorce decree my wifes lawyer said she did not have the address of my employer,and had just gotten it so as to verify my employment.I was told by her it would take another two weeks for the judge to sign the divorce decree and it would be back dated to the date of the court apearence. Is it legal to back date a legal document? Isn't the divorce decree suposed to be done before the judge grants a divorce? Is any of this normal?
