Legal Question in Family Law in Virginia

Divorced

I have been divorced for 3 years now. In the divorce settlement, I recieve half his retirement. I was married to this person for 25 years. The problem is I need the money now to get back on my feet not when he is dead and gone. Is there any way I can get the money now. It is through the VA retirement system They won't give me any information on this at all. Keep telling me that I can not get this money till he passes away.

Re: Divorced

If you received half of your former spouse's retirement pay in your divorce settlement, then that's what your entitled to receive whenever this person begins receiving this retirement and not when he dies. There's a Pentagon office of military financial affairs which is concerned with such matters which should be able to advise you as to how exactly you go about qualifying for and submitting your claim for one half of your ex-spouse's retirement benefit and which should be referenced with a link on the DOD's website.

You should be able to find your answer to your question there.
