Divorcing an illegal immigrant

I married my college sweetheart in 2003 in Virginia. 2 years later he moved to NYC for work while I was still in college. I found out in 2006 that he never finished college and was here on an expired student visa. I now live in WV and I believe he is still in NYC. I haven't talked to him or seen him in 2 years. Can I get a diorce in Virginia even though I'm no longer a resident? Can I get constructive service in Virginia?

Forget about divorcing in Virginia; if you're now a bonified resident of West Virginia, you can file there for divorce.
