Legal Question in Family Law in Virginia
Domestic Assault
I attendaed a fam. reunion in Ga. I left my husband at home to watch the place. He promised me he would not drive anywhere if he was drunk while I was gone. He is a 3 time offender (dui). He broke the promise but did not get caught - except by me. I can tell when he's lying, so I played a little game that maybe I shouldn't have. I told him someone I knew saw him out. I then got more of a confession than I bargained for - not only did he go out, he went out with a bad news buddy and his girlfriend - and another girl - to a bar. He told me he drove back to our house at 3:30 am completely wasted. I blew a fuse and started screaming at him for putting our security in jeopardy (we own our own home and have a 15 year old son - we both have good jobs) On this night, he had consumed 25 beers. He grabbed me by the wrists and slammed me into the wall. I tried to push him away and he bit my hand, so I scatched his face. I called the police to try and have them make him leave for the night. They arrived, saw his scratches and wouldn't even look at the body bruises I had but did see the bite on my hand. They arrested me for domestic assault and took me to jail for 3 days with no bond. Why is this legal? I'm traumatized-can I sue my city?

Re: Domestic Assault
Instead of suing the city, you had best first start with securing a competent criminal defense counsel to represent you on this domestic assault and battery charge.
A conviction on this misdemeanor offense could have many adverse and unanticipated consequences for you in the future and should be avoided at all costs.
