domestic violence

i am a victim of domestic violence and my husband is in jail awaiting trial. my name is not on any of our property, banking information or any thing now he wants to give his power of attoreny to his daughter. i need to know what my rights are. he does receive a pension thr disabled veteran and social secority disabilty. am i entitled to any of these benfits i am out of work due to the injuries i received i need any help available thank you

You should seek a consultation with an attorney who is appropriately versed in Virginia family law issues who likely will advise that under your particular circumstances that a petition for pendente lite support be filed in your behalf in the local circuit court seeking spousal support for yourself and child support for any child(ren) whom your husband may also have a duty to support along with a request that the court award you the right to remain in the home and that he be required to vacate the premises and that the court further order that a CPO (Civil Protection Order) be entered for your future safety.
