Legal Question in Family Law in Virginia

am due in court for back child support. support is for 2 kids. the amount owed is for 2 kids. the eldest has not been in his moms care for over 2 years and has been in prison for at least a year. am going to petition court for child support review and adjustment of what i owe because of eldest child. should i seek a continuance of my child support case until my petition is reviewed?

No, probably best to have it all taken care of at one court hearing(in my opinion).

I seems to me that you should be collecting all the evidence you have that one of the children is not living with the mother, and/or is emancipated -- not in school, not with the mother, and self-supporting.

That evidence can be presented at the support hearing already scheduled without your having to file a separate motion.
