Emancipation

My wife and I have a 17 1/2 year old son that will not follow our rules and has requested that we allow him to move out. I would like to know my legal rights and what we will have to do to have him emancipated.

My first piece of advice is to try and take control of your minor son. You only have six months until he is emancipated by viture of law at age 18. It will take almost that long to go through the emancipation process. Guidence of how to use the law and social services to take control can be accessed through your local Dept of Health and Human Services.

Emancipation petitions are filed at the local Juvenile & Domestic Relations Courthouse. The Court will appoint a Guardian for the juvenile and report back to the Judge what is in the child's best interests. The jevenile must have an independent source of income, a reliable place of residence and another mentor adult who will also report to the Court on the juvenile until he reaches majority.

I doubt it is an option at your child's age. Lastly the message it sends that you have given up on him is life altering. I advise parenting training instead.
