Legal Question in Family Law in Virginia
Enrolled in an Higher Education Insitution
In my divorce decree it states that I will pay child support as long as the child is pursuing a higher education. If the child is 22years old and gets an academic semester suspension, am I still required to pay child support for him? Does this also mean that I have to continue to pay child support as long as he is in school even if he is 25-30 years old?

Re: Enrolled in an Higher Education Insitution
In Virginia the law requires that child support continue until age 18 or, if the child is in high school full time, living at home, and not self supporting (more than a paper route), until age 19. Additionally, child support can be continued for the life of the child if the child is disabled and cannot be self supporting.
For the court to order you to pay support beyond age 19, you have to have agreed to that either by Separation Agreement (sometimes called Stipulation and Property Settlement Agreements by attorneys who charge by the word) or by agreed order. You need to look back at your files to see what you signed or agreed to.
