Can I evict my estranged spouse from the residence we once shared, if he is not paying the mortgage and ruining my credit? Can I serve him 30 days notice, so that I may move back into in the residence and pick up the payments, in which he is 3 months past due on?

No, not if he's still on the title/deed as a co-owner of the property.
