Legal Question in Family Law in Virginia

evict mother-in-law

My husband attacked me and threatened to kill me. A protective order grants me possession of the family home where I live with my mother-in-law. I filed for divorce. The house is very large. She uses a separate entrance. My mother-in-law fell. I did not know it. My husband is suing me claiming neglect. He wants to void the protective order and gain possession of the house. Can I evict her? Can I move her out to his house against her will?

Re: evict mother-in-law

Yes (you can evict the mother-inlaw), if you've been granted sole possession of the marital home, you have the sole right to determine who lives there (in my opinion). However, where she goes would not be up to you.
