Legal Question in Family Law in Virginia

Ex-Boyfriends wants a DNA test

my exboyfriend wants me to provide my son for a paternity test. I am married to the man I know is his father and on his birth certificate. Since I know this ex isn't my son's father do I have the right to refuse the test?

Re: Ex-Boyfriends wants a DNA test

When and if this former boyfriend files a petition

under Va. Code Sec. 20-49.2 to have such a paternity test ordered by the court, you would have the right to appear and contest his action on the grounds that there is insufficient "probable cause" (evidence)for the court to order such a test.
