Legal Question in Family Law in Virginia
my ex-husband has given consent for my husband to adopt our daughter. We went to our preliminary court (without an attorney) and were told we needed to complete a homestudy (provided by social services). We have a completed homestudy (private agency) completed in 2008 bc we adopted another child. Social services sent a packet with info. saying that me and my husband have to do all kinds of preliminary things such as the criminal background search and everything. The child is biologically mine and I am her sole custodian she has had almost no contact with her birth father for seven years (she is now 11). She has lived with me always and my husband also since our marriage in 2006. Some of the requirements seem unnecessary - i didn't think a homestudy was even requried since the child is mine and I'm not adopting her???

If the court ordered a home study to be completed as part of the
step-parent adoption process (knowing full well, of course, that you're
the biological mother of the subject child), such a study will need to
be completed before the adoption can go forward.
